1. Introduction

These Terms & Conditions govern your use of the FabTax website at fabtax.com.au and your engagement with the services provided by Flinders Accounting & Business Services Pty Ltd (ABN 35 523 551 366), trading as FabTax.

By using our website or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or engage our services.

These Terms & Conditions should be read in conjunction with our Privacy Policy and Disclaimer, both of which form part of our agreement with you.

3. Services

FabTax provides tax accounting, bookkeeping, and business structuring services to individuals, investors, and business owners across Australia. Our services include but are not limited to:

  • Individual tax return preparation and lodgement
  • Business tax return preparation and lodgement
  • Property investor tax return preparation and lodgement
  • Business structuring advice and implementation
  • Small business bookkeeping
  • SMSF setup and ongoing accounting
  • Cryptocurrency tax services

All services are provided by or under the supervision of a Registered Tax Agent in accordance with the Tax Agent Services Act 2009 (Cth) and the Code of Professional Conduct set by the Tax Practitioners Board.

FabTax does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice as defined under the Corporations Act 2001 (Cth). Where financial planning advice is required, we will refer you to an appropriately licensed professional.

 

4. Engagement of Services

4.1 Engagement Process

Our engagement begins when you complete a booking or quote request and we confirm acceptance of your engagement in writing or by email.

4.2 Engagement Letter

For ongoing or complex engagements, we may provide a separate engagement letter setting out the specific scope, fees, and terms of your engagement. Where an engagement letter is provided, it forms part of these Terms & Conditions and takes precedence in the event of any inconsistency.

4.3 Scope of Services

We will provide the services agreed at the time of engagement. Any additional services requested outside the agreed scope will be quoted separately before work commences.

4.4 Client Obligations

To enable us to provide our services effectively, you agree to:

  • Provide complete, accurate, and timely information and documents as requested
  • Notify us promptly of any changes to your circumstances that may affect our services
  • Review and approve documents prepared on your behalf before lodgement
  • Maintain adequate records in accordance with ATO requirements
  • Respond to our requests within agreed timeframes

We are not responsible for errors, delays, or adverse outcomes resulting from incomplete, inaccurate, or late information provided by you.

 

5. Fees and Payment

5.1 Fee Structure

Our fees vary depending on the nature and complexity of the services provided. Where applicable, fees are:

  • Quoted upfront before work commences
  • Provided on a starting-from basis for standard services
  • Confirmed in writing before any work begins

We confirm your fee before commencing work. You will not receive an unexpected bill.

5.2 Booking Deposit

Certain services require a booking deposit to secure your appointment. This deposit is applied toward your final fee. The booking deposit is non-refundable if you cancel with less than 24 hours notice, see clause 6 for our full cancellation policy.

5.3 Payment Methods

We accept the following payment methods:

  • Credit or debit card via Stripe
  • Electronic funds transfer (EFT)
  • Direct debit where agreed
  • Payment from tax refund proceeds where applicable and agreed in advance

5.4 Payment Terms

Unless otherwise agreed in writing, payment is due:

  • For bookings: at the time of booking or as confirmed in your booking confirmation
  • For ongoing services: monthly in advance or as set out in your engagement letter
  • For one-off services: on completion or as confirmed prior to commencement

5.5 Overdue Payments

Overdue accounts may be subject to interest at the rate of 10% per annum calculated daily. We reserve the right to suspend services for accounts that remain unpaid beyond 30 days of the due date.

5.6 GST

All fees are inclusive of GST unless stated otherwise.

 

6. Cancellation and Rescheduling

6.1 Appointments

We understand that circumstances change. To cancel or reschedule an appointment, please contact us as soon as possible.

  • Cancellations or reschedules made more than 24 hours before your appointment: your booking deposit will be applied to a rescheduled appointment or refunded at our discretion
  • Cancellations or reschedules made within 24 hours of your appointment: your booking deposit is forfeited
  • No-shows without prior notice: your booking deposit is forfeited and a new deposit will be required to rebook

6.2 Ongoing Engagements

For ongoing engagements such as bookkeeping retainers, a minimum notice period of 30 days is required to cancel. Fees for work completed prior to cancellation remain payable.

6.3 FabTax Cancellation

We reserve the right to cancel or reschedule an appointment where necessary. In such circumstances, we will provide as much notice as possible and offer an alternative appointment time. No cancellation fee will apply.

 

7. Confidentiality

We treat all client information as strictly confidential. We will not disclose your personal or financial information to third parties except:

  • As required to provide our services, including to the ATO and third-party platforms listed in our Privacy Policy
  • As required by law or regulatory obligation
  • With your express consent

Our confidentiality obligations survive the termination of our engagement.

 

8. Intellectual Property

All content on the FabTax website, including text, graphics, logos, and downloadable resources, is the intellectual property of Flinders Accounting & Business Services Pty Ltd unless otherwise stated. You may not reproduce, distribute, or use our content without our prior written consent.

 

9. Website Use

9.1 Accuracy of Information

We make reasonable efforts to ensure the information on our website is accurate and up to date. However, tax laws change frequently and website content may not reflect the most recent legislative changes. You should not rely on website content as advice specific to your situation.

9.2 Links to Third-Party Websites

Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of third-party websites. The inclusion of a link does not constitute endorsement.

9.3 Availability

We do not guarantee that our website will be available at all times. We may suspend or discontinue the website at any time without notice.

 

10. Limitation of Liability

10.1 General Limitation

To the maximum extent permitted by law, FabTax’s liability to you for any loss or damage arising from our services or website, whether in contract, tort, or otherwise, is limited to the fees paid by you for the specific service that gave rise to the claim.

10.2 Consequential Loss

To the maximum extent permitted by law, FabTax is not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of revenue, or loss of data, arising from your use of our services or website.

10.3 Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot be excluded by agreement.

10.4 Professional Standards

Our liability may be limited by a scheme approved under the Professional Standards Legislation. Further information on the scheme is available from the relevant professional standards authority.

 

11. Complaints

We are committed to resolving complaints promptly and professionally. If you have a complaint about our services:

Step 1, Contact us directly

We will acknowledge your complaint within 5 business days and respond substantively within 30 days.

Step 2, Tax Practitioners Board

If you are not satisfied with our response, you may lodge a complaint with the Tax Practitioners Board at www.tpb.gov.au. The TPB is the regulatory body for tax agents in Australia and has the authority to investigate complaints about tax agent conduct.

Step 3, Other regulatory bodies

Depending on the nature of your complaint, you may also have recourse to:

  • The Australian Financial Complaints Authority (AFCA), for complaints about financial services
  • The Office of the Australian Information Commissioner (OAIC), for privacy-related complaints

 

12. Termination

Either party may terminate an engagement by providing written notice. Upon termination:

  • All fees for work completed to the date of termination remain payable
  • We will provide you with all documents and information held on your behalf in a reasonable timeframe
  • Our confidentiality obligations continue to apply

We reserve the right to terminate an engagement immediately where:

  • You have provided false or misleading information
  • You have failed to pay fees when due
  • Continuing the engagement would place us in breach of our professional obligations

 

13. Governing Law

These Terms & Conditions are governed by the laws of South Australia, Australia. Any disputes arising in connection with these Terms & Conditions will be subject to the exclusive jurisdiction of the courts of South Australia, without limiting your rights under the Australian Consumer Law or any other applicable federal legislation.

 

14. Changes to These Terms & Conditions

We may update these Terms & Conditions from time to time. The current version is available at fabtax.com.au/terms/. Continued use of our services after any update constitutes acceptance of the revised Terms & Conditions.
